Deposit
- The Client will pay Beau Son Strings 25% of the total amount due as a deposit when the contract is signed & finalized. This deposit is non-refundable. This will secure the date and if deposit is not received, the Performer may cancel the Agreement without further obligation.
*Some specialized instruments such as harp, bagpipes, etc. may require a deposit at the time of booking as well. This will be seen in your proposal.
*Deposit is part of the total amount due.
Payment
- *For your convenience, we accept various payment methods, including credit card payments. Please note that if you choose to pay by credit card, a 3% surcharge will be added to the total amount.
- The Client will pay Beau Son Strings no later than 14 days prior to the event date.
- *If full payment is not received 2 weeks prior to the ceremony then a penalty of $5 will be added each day it is late.
Overage Fees
- Any music played past the time frame as stated in Section 4 will incur a charge of $50 per 15 minutes (per musician).
- This overage will be charged via invoice the day after the event and needs to be paid within 7 business days.
Travel Fees
- Travel time in the St. Louis area will be determined by distance from West County Center (off 270 & Manchester) to venue location.
- There will be a flat rate fee of $50 per musician if travel time* is between 30-60 minutes.
- There will be a flat rate fee of $100 per musician if travel time* is between 61-120 minutes.
Cancellation
- The Client reserves the right to cancel this Agreement without obligation upon written notice to the performer on or before six weeks prior to set event date In the event of said cancellation, any payment paid will be returned promptly. *This does not include the deposit. Deposit is non-refundable.
- Cancellation by the Client for any reason on or after one month prior to set event date, will result in forfeit of the deposit and any amount already paid.
Force Majeure
- Neither the Performer nor Client will be held liable for any failure to perform its obligations under this Agreement where such breach is due to any of the following: acts or regulations of public authorities, labor difficulties or strike, inclement weather, epidemic, interruption or delay of transportation service, acts of God, or any other legitimate cause beyond the reasonable control of the Performer or Client.
Sickness and Accidents
- The Performer agrees to meet its obligations under this Agreement subject to legitimate incapacity by sickness or accident. Failure to meet its obligations under this section will result in the Performer returning payments to the Client. *This does not include the deposit.
Weather and Outside Performances
If ceremony/performance is outside the following conditions must be met:
- The temperature must remain above 60 degrees Fahrenheit as cold conditions pose a risk of damage to instruments, potentially leading to costly repairs.
- In the event that weather forecasts indicate temperatures below this threshold, a contingency plan must be established at least one week prior to the ceremony date.
- Musicians must be covered or in a shaded area. Direct sunlight and heat can cause damage to instruments that include expensive repairs.
- Should the Client opt for an outdoor event without sufficient covering, the Client acknowledges that in the event of rain without adequate protection, the performers will be relieved of all obligations. Furthermore, such circumstances will be regarded as the Client canceling the performance on that date, subjecting them to the cancellation provisions outlined above.
Miscellaneous Terms
- The Client will provide chairs for the Performer if there is not already a designated area with seating.
- The Performer will arrive at least one hour prior to event time to begin setup for the event.
- Attire and Conduct: The musician agrees to dress appropriately for the event and conduct themselves in a professional manner at all times. Any specific attire requirements should be communicated to the musician in advance.
- Event Logistics: The client shall provide detailed information regarding the event venue, including address, parking availability, load-in/load-out procedures, and any relevant contact persons or event coordinators.
- The Performer explicitly assures and affirms that all copyrighted material intended for performance has been duly licensed or authorized by the respective copyright owners or their representatives. Furthermore, the Performer agrees to indemnify the Client against any claims of copyright infringement and associated expenses arising during or as a consequence of the Performance.
- The parties to this Agreement aim to establish the Performer as an independent contractor, granting them control over the method and execution of the Performance. The Client will oversee the scheduling of the Performance. It's clarified that the Performer is not employed by the Client. The exclusivity of this Agreement is confined to the Performance duration, with the expectation that the Performer will engage in similar agreements with other Clients.
